PHMSA under the Department of Transportation has given the American Petroleum Institute the ability to decide whether a massive, polluting compressor station at the start of a transmission line gets an environmental review under NEPA. Clearly the statutory intent of the law was from the government to regulate industry, not for the government to let the industry regulate themselves.
