Background

The company states that the Bhaiyathan Power Project "is being developed through a PPP model with the Chhattisgarh State Electricity Board. The Company was awarded to build, own, operate and maintain this Bhaiyathan project through a competitive bidding process... ICBPL and CSEB have entered into a long-term PPA dated October 13, 2008 for the sale of 65% of power that will be generated by the Bhaiyathan Power Project aggregating approximately to 858 MW of electricity. The PPA is for a term of 25 years from the date of commencement of commercial operation of the power project. ICBPL proposes to sell the remaining power capacity on merchant basis. ICBPL will construct a 400 kV double circuit transmission line from the project site to the interconnection point for evacuating the entire power produced at the Bhaiyathan Power Project."[1]

Project Cancelled

On December 12, 2011, Indiabulls informed the government of Chhattisgarh that it was terminating the project due to failure to receive Environmental Clearance (EC) from the Ministry of Environment and Forests. Indiabulls subsequently sued the government of Chhattisgarh for damages under the terms of the Power Purchase Agreement, claiming that the government's failure to secure land for the project had resulted in the failure to received an EC.[2]
