Lawsuit
At least 150 families lost their water in 2000 and 2001 after Massey Energy’s Delbarton Mining longwalled under Riffe Branch, nearby Duncan Fork, Academy Bottom and Hillman Drive. The company was ordered to provide residents with a temporary water supply after its mining destroyed their natural water supply, but residents claimed the water the company provided, stored in plastic containers, was contaminated with bacteria, including e-coli. A lawsuit was then filed by residents of of Delbarton alleging they received contaminated water from Massey’s Delbarton Mining Co.[2]
In 2004 a civil jury ordered Massey Coal Services to pay $1.54 million in damages to the 245 residents for drying up their water wells after the company began mining under their homes. After six weeks of testimony and more than 40 hours of deliberation, the jury concluded that Massey acted “with malicious, willful, wanton, reckless or intentional disregard for plaintiffs’ rights.”[3]
